appeal period has passed without the Member electing to proceed with an appeal.

K. Procedure for Grievances Not Arising out of a Member’s Conduct . For violations of the Governing Documents not arising out of a Member’s conduct, the grievance process will be as follows:

1. Administrative Function. Violations of the Governing Documents will be addressed as an administrative function by the Executive Director.

2. Notice of Violation. Senior Management shall send the Member notice of the alleged violation, describing the violation, the provisions of the Governing Documents violated, and a date upon which the Member will be expected to correct the violation. 3. Failure to Cure Violation. If the violation is not cured or if the violation is a repeat violation, the Executive Director will notify the Board of Governors, which may levy a fine or suspension. No fine may exceed $100.00 for each day during which the violation is continuing. The length of any suspension shall be within the discretion of the Board of Governors. All suspensions provided for therein shall include all Recreational Facilities and the suspension of the Member’s resident gate access transmitter. 4. Notice of Disciplinary Action. If the Board of Governors levies a fine or suspension, Senior Management shall notify the Member describing the conduct complained of with reasonable specificity, the provisions of the Governing Documents violated, and the fine or suspension levied. The notice shall specify the date the fine will become due, or the date the suspension will become effective, which shall in no event be less than fourteen (14) days from the date of the notice. The notice shall also advise the Member of his or her right to appeal by submitting written notice of such appeal to Senior Management within fourteen (14) days of the notice described in this paragraph. 5. Appeal; Public Notice. If a Member submits timely notice of appeal, the appeal will be handled in the same manner as is specified in Section J.6 above. If the disciplinary action is sustained by the appeals panel, public notice will be given as specified in Section J.7 above. L. Procedure for Grievances Relating to Speeding. For violations involving speeding within the Frenchman’s Creek community, the following provisions and guidelines shall apply to the Grievance Committee procedure in addition to those set forth in paragraph B of this Article XIV. For speeding violations, all suspensions shall automatically include all Recreational Facilities and the suspension of the Member’s resident gate access transmitter, while the Member is in residence. 1. Speeding by a Member or Driver of a Member’s Vehicle . For speeding violations committed by a Member or by any other person (other than an employee of the POA) driving the Member’s vehicle, the following schedule of penalties shall apply:
