Governing Documents. Before initiating a formal grievance, the person intending to initiate it will discuss with Senior Management and the Chair in order to provide an opportunity for mediation and resolution without a formal hearing.
C. Reporting of Violations of the Governing Documents.
1. Employees. Employees have been instructed to report promptly in writing violations of the Governing Documents by Members or guests to a member of Senior Management. 2. Members. Members who observe a violation of the Governing Documents, are requested to report promptly in writing the violation to a member of Senior Management, the Board President or a member of the Board of Governors. Members are requested not to attempt to address the violation with the other Member, but to report it as provided in these Rules. 3. Method of Reporting Violations. Senior Management will make available to employees and Members a form (a “Violation Reporting Form”) for the purpose of enabling an employee or Member to report suspected violations of the Governing Documents, other than violations covered by Section L of this Article. The form will indicate the office to which it is to be submitted and the means by which it may be submitted, which will include email. Any employee or Member may also elect to submit the information requested on the Violation Reporting Form in person or by phone, rather than in written form, and Senior Management will make a staff member available to speak with the employee or Member and will complete a Violation Reporting Form based on that conversation. The Violation Reporting Form will include an option for the employee or Member to elect not to have such employee’s or Member’s identity disclosed to the Member who is the subject of the Violation Reporting Form. 4. Reporting by President or Board Members. If the President or two members of the Board of Governors wish to initiate the process of bringing a grievance such person(s) will first submit a Violation Reporting Form to Senior Management. 5. Whistleblower Policy . If the Club has in effect a “Whistleblower Policy” under which employees may report violations of the Governing Documents by Members, employees may elect to report a potential violation of the Governing Documents by a Member under either that policy or these Rules. If the employee reports under these Rules, the employee will be entitled to the same protections as are provided under the Whistleblower Policy, including without limitation with respect to confidentiality and protection from retaliation. If an employee reports a potential violation of the Governing Documents by a Member under the Whistleblower Policy, the President will refer the matter to Senior Management and the Chair by completing a Violation Reporting Form if the President believes the potential violation could result in a grievance.
