retaliation includes, but is not limited to termination, demotion, suspension, reduction of compensation, denial or reduction of any employee benefit, adversely affecting such employee ’ s working conditions or otherwise. Any report by a Whistleblower of retaliatory conduct will be promptly investigated by the Executive Director, or in the case of retaliatory conduct by The Executive Director or a member shall be investigated by, or at the direction of The President, in a thorough and objective manner. If a report of retaliation is substantiated, appropriate disciplinary action up to and including termination of employment will be taken. The Prohibitions contained in this paragraph shall not apply to malicious allegations.

EXISTING LAW:

The employee protections contained in this Whistleblower Policy are in addition to, and shall in no way limit, the applicability of relevant provisions of the Employee Handbook, Federal and State law, including, but not limited to Sections 448.102 and 448.103 of Florida Statutes.

ARBITRATION

X.

All claims, disputes or controversies based upon the any legal right or cause of action relating to or arising from employment and/or termination of employment shall be submitted to and resolved by binding arbitration. Within ten (10) days after delivery of a written notice of claim from one party to the other, the Director of Human Resources for Frenchman ’ s Creek shall apply to the Mediation Services for the Fifteenth Judicial Circuit in and for Palm Beach County, Florida, for appointment of a single arbitrator who is both certified and specializes in employment law and employment- related issues and the decision of the arbitrator shall be final and binding upon the parties thereto. The arbitrator shall have the power to grant temporary, preliminary or permanent injunctive relief, or any extraordinary remedy in addition to an award for monetary damages where appropriate. The arbitration shall be held in Palm Beach County, Florida, in accordance with the Florida Arbitration Code. The parties shall be entitled to avail themselves of all discovery procedures available in civil actions in the State of Florida pursuant to the Florida Rules of Civil Procedure. The initial cost and fees of arbitration shall be borne equally by each party. The arbitrator may apportion the costs and fees of arbitration as part of a final award. Judgment on awards rendered by the arbitrator may be entered in any court having jurisdiction.

TERMINATION

When you leave the employ of Frenchman ’ s Creek, your continuous service is ended. If you are rehired, your benefits will begin according to the employment classification at the time of rehiring.

A.

Resignation

Frenchman ’ s Creek recognizes that you may choose to end your employment at will. In consideration of the effect this transition has on Frenchman ’ s Creek ’ s operations, Frenchman ’ s Creek requires a minimum of one month ’ s notice for executive personnel; this will maximize the potential for a smooth transition. For all other employees, two (2) weeks ’ notice is requested. Notice of resignation is submitted to your supervisor and forwarded to the Director of Human Resources.
