Community and the Member shall receive a one (1) week suspension and a One Hundred Dollar ($100.00) fine.
4. Cumulative Violations. For purposes of this Section L, all violations of a comparable type committed by persons for whom the Member is responsible shall be cumulative, even if committed by different persons. 5. Process for Grievances Relating to Speeding Violations. Senior Management shall notify any Member alleged to have committed a speeding violation, indicating the penalty to be imposed on the Member or, if applicable, a warning. A Member who receives notice of the imposition of a penalty may accept the fine and, if applicable, the suspension prescribed above by delivering notice to Senior Management within ten (10) days. Such notice shall be accompanied by payment of the fine and, if applicable, acknowledgement of the suspension. If the Member fails to deliver such notice, payment and acknowledgement when required, or if the Member wishes to contest the fine or suspension, the matter shall be referred to the Grievance Committee and will be handled in the manner described in Section J above for grievances arising out a Member’s conduct, except that the final determination shall be made by the Grievance Committee, instead of the Board. Alternatively, rather than convening the entire Grievance Committee, the Chair may select not less than three members of the Committee to hear any speeding appeal and to act for the Committee under this Section. In any such process, the Grievance Committee (or subset) may impose penalties that are lesser or greater than those provided in the foregoing guidelines. 6. Presumption About Identity of Driver . If the identity of the driver of a Member’s car that is speeding cannot be determined the driver shall be presumed to be the Member, unless the Member can prove otherwise. 7. Applicability of Suspensions to Related Persons. The suspension imposed for a first speeding offense shall only apply to the Member who committed the violation or who is responsible for the person who committed the violation, as described above. Suspensions for subsequent speeding offenses by the same Member or by anyone for whom the Member is responsible, as described above, and that occur within twelve (12) months of the immediately previous suspension shall also apply to all persons authorized to use the Member’s Recreational Certificate. M. Timing for Serving Suspensions. All suspensions shall be served only while the Member is in residence. Unless Senior Management elects otherwise, all suspensions shall commence on the day after any appeal has been exhausted without a decision in favor of the Member or the appeal period has passed without the Member electing to proceed with an appeal. Senior Management will notify the Member of the commencement of any suspension period. N. Recordkeeping. All notices, reports and forms relating to a grievance or potential grievance involving a Member will be kept in a file maintained by Senior Management with respect to such Member.
