delivered, sent by regular mail or recognized overnight delivery service, or by email addressed to Senior Management or a person designated by them.

I. Member Responsibility for Conduct of Guests and Others. All Members are responsible for the violations committed by all other persons with use rights pursuant to their Recreational Certificate, their family members, guests, employees and independent contractors, and are subject to disciplinary action for such violations. R eferences in this Article to a Member’s conduct include the conduct of such other persons. J. Procedure for Adjudicating Grievances Arising out of a Member’s Conduct . Where a grievance is brought arising out of a Member’s conduct, other than a speeding violation covered in Section L below, the grievance process shall be as follows: 1. Notice and Scheduling of the Grievance. Senior Management shall send the Member written notice of the alleged violation, describing the conduct complained of with reasonable specificity, the provisions of the Governing Documents violated, and a date to appear for a hearing before the Grievance Committee. The Member is requested to respond to Senior Management acknowledging receipt of the Notice, but failure to respond will not affect the grievance process. 2. Rescheduling. The Member may request a rescheduling of the Grievance Committee hearing for not more than thirty (30) days from the originally scheduled date. In that event, the Chair will work with the Member to find a mutually acceptable date for the hearing, but if no such date can be agreed upon the Chair may schedule the meeting on a date that is convenient for the Committee. (a) Procedure. The Grievance Committee will be conducted in person, over Zoom or other remote conferencing system, or a combination of in person and remote attendance, as determined by the Chair. The Chair will seek to accommodate any request to attend remotely. The Chair will preside at the hearing and set the agenda and time allotted for each participant. Unless the Chair determines otherwise, each hearing will proceed as follows: (i) discussion among committee members only, (ii) testimony from witnesses against the accused Member, (iii) testimony from witnesses for the accused Member, (iv) testimony of the accused Member and/or such Member’s representatives, and (v) further discussion among committee members only. The hearing may not be recorded by any participant, witness or other person or entity. (b) Attendance. The Member who is the subject of the grievance may elect to attend the Grievance Committee hearing, or elect not to attend, in which case the hearing will proceed without the Member ’s participation.
